General Terms and Conditions of Sale

Article 1 - Presentation and Identification of the Seller

The company Möss, whose legal information is available on the website, is an e-commerce platform accessible via the Internet.

The website Möss-paris.com is published by the company MÖSS, with a capital of 15,500 euros, headquartered at 9 rue des Colonnes, 75002 Paris, and registered with the Paris Trade and Companies Register under number 980 711 592.

Article 2 - General Provisions Related to These General Terms and Conditions of Sale (hereinafter referred to as the GTC)

  1. Purpose of the GTC
    The GTC apply exclusively to online sales of Möss products on the website moss-paris.com.

  2. Scope of the GTC
    The GTC exclusively govern online sales contracts for Möss products (hereinafter referred to as the professional seller) to buyers who are consumers (hereinafter referred to as consumers) and constitute, together with the online order, the binding contractual documents between the parties. Other documents, such as brochures, catalogs, or product photographs, are for informational purposes only.

The GTC apply exclusively to products delivered to consumers established in France and/or in a member country of the European Union.

The GTC and all contractual information on the website are provided in French.

  1. Availability and Enforceability of the GTC
    The GTC are made directly available to consumers on the seller’s website. Consumers acknowledge, by ticking a box provided for this purpose, that they have read and accepted them before placing an order.

Confirming an order constitutes the buyer's adherence to the GTC in effect on the date of the order. Möss ensures the preservation and reproduction of the GTC in accordance with Article 1127-2 of the French Civil Code.

  1. Modification of the GTC
    The professional seller reserves the right to modify the GTC at any time.

In the event of modification, the applicable GTC are those in effect on the date of the order. A dated copy of the applicable GTC can be provided to the consumer upon request.

  1. GTC Clauses
    If any clause of the GTC is deemed invalid, the validity of the remaining provisions remains unaffected. The temporary or permanent non-enforcement of one or more clauses by the seller does not constitute a waiver of the other provisions, which remain in effect.

Article 3 - Products

  1. Characteristics
    Each product available for sale is described in the catalog on the website, with details of its essential characteristics, in accordance with Article L. 111-1 of the French Consumer Code.

Product photographs are for informational purposes only and do not constitute a contractual document.

  1. Product Use
    The website offers products intended for personal care. These products are for individual consumer use only.

Some products may pose risks if used incorrectly. Möss provides consumers with the necessary information for proper use.

Any therapeutic use of our products should be supervised by a qualified healthcare professional.

Möss is not liable for damages resulting from improper use of the products or failure to follow usage precautions.

  1. Compliance
    Products comply with current regulations concerning consumer safety, fair commercial transactions, and consumer protection at the time they are marketed.

Products meet French legal requirements at the time of sale.

  1. Stock Availability
    Products are offered and delivered while stocks last.

If a product is unavailable, the seller will immediately inform the buyer and may offer a substitute product of equivalent quality and price or issue a store credit for future purchases.

If the buyer does not agree to these alternatives, the seller will issue a refund within five business days.

Beyond refunding the unavailable product, the seller is not obligated to provide any further compensation unless the non-performance of the contract is directly attributable to the seller.

  1. Resale of Products
    Products purchased on the website may not be resold without the written consent of Möss.

Products may not be repackaged and resold without Möss’s written authorization.

Article 4 - Pricing

  1. Sale Price
    In compliance with Article L. 112-1 of the French Consumer Code, product prices are listed in euros, inclusive of all taxes, but exclude delivery and shipping costs. These additional charges are displayed before order confirmation.

The total amount due by the consumer is displayed on the order confirmation page.

The price applicable to a product is the price in effect at the time of the order.

If promotional pricing is applied, Möss guarantees the advertised promotional price for all orders placed during the promotional period.

  1. Price Modification
    Möss reserves the right to modify its prices at any time, while ensuring that the price applicable at the time of the order remains unchanged for the consumer.

  2. Additional Fees
    Shipping and any additional costs are detailed on the order confirmation before payment.

Article 5 - Offer

  1. Scope
    The online sales offers presented on the website are reserved for consumers residing in France and/or in a European Union member country, with deliveries limited to these regions.

  2. Duration
    Unless otherwise stated, online sales offers remain valid as long as the products are listed in the electronic catalog and available in stock.

  3. Acceptance
    The consumer's acceptance of the offer is validated through a double-click process by confirming the order.

Article 6 - Order

  1. Order Process
    To place an order, the consumer selects the desired products and quantities, adds them to the shopping cart, and clicks "Order." They then enter delivery and payment information.

Before clicking "Confirm Order," the consumer can review the order details and total price and make changes if necessary.

Confirming the order implies acceptance of the GTC and forms a binding contract.

A confirmation email acknowledging receipt of the order and payment is sent to the consumer promptly.

  1. Order Modification
    Any modification to an order after confirmation is subject to the seller’s approval.

The seller reserves the right to make modifications to the product ordered if necessary due to technical developments, as permitted by Article R. 212-4 of the French Consumer Code.

  1. Order Validation
    The seller reserves the right to refuse any order for legitimate reasons, especially if the quantities ordered appear unusually high for an individual consumer.

The seller may also refuse or delay order processing in cases of suspected fraud, such as identity theft or payment fraud.

Article 7 - Contract

  1. Formation
    The sales contract is formed when the consumer confirms their order.

  2. Archiving and Proof
    All communications, orders, and invoices are archived on a secure and durable medium to ensure an accurate and lasting record, in accordance with Article 1360 of the French Civil Code. These documents may be used as proof of the contract.

Article 8 - Payment

  1. Payment Terms
    The total price is due immediately upon order confirmation. Payment is made by credit card at the time of purchase.

  2. Payment Security
    The website uses a secure online payment system to encrypt consumers’ banking data via a secure payment gateway. Möss does not process or store any banking information.

Article 9 - Delivery

  1. Definition
    Delivery refers to the physical transfer of the purchased goods to the consumer.

  2. Shipping Time
    Under normal conditions, the seller processes orders as quickly as possible from Monday to Friday, excluding public holidays. Möss commits to shipping orders within 24 business hours after order validation, subject to stock availability.

  3. Delivery Timeframe
    Orders are shipped via La Poste, its subsidiaries, or Mondial Relay, based on the customer’s choice, with an estimated delivery time of 2 to 3 days within mainland France or Belgium.

For deliveries to French overseas territories (DOM-TOM) or international destinations, orders are handled by La Poste and its local partners. Delivery times vary depending on the region or country.

A same-day delivery option is available from Monday to Friday for customers in Paris. Orders placed before noon are delivered the same day via La Poste. Orders placed after noon will be delivered the next business evening. If delivery is unsuccessful due to the customer’s unavailability, Möss cannot be held responsible.

To facilitate delivery, the customer agrees to provide necessary details, such as a visible name on the mailbox, access codes, or a contact phone number.

  1. Late Delivery
    If delivery is delayed by more than five business days, the customer should contact Möss customer service, which will take appropriate action.

  2. Delivery Address
    Products are delivered to the address specified by the customer at the time of ordering.

  3. Product Conformity
    If a product does not match the order, the consumer must submit a complaint to the seller to request a replacement or, if necessary, a refund.

  4. Transfer of Ownership
    Ownership of the product transfers to the buyer upon the indicated delivery date, except in cases where full payment has not yet been received.

Article 10 - Product Returns and Right of Withdrawal

The consumer has 14 days from the receipt of their order to return any unwanted items for exchange or refund. Return shipping costs are at the consumer’s expense.

The right of withdrawal can be exercised through Möss customer service or via the "Contact Us" and "FAQ" sections on the website. The customer will receive a confirmation of withdrawal on a durable medium (e.g., email) without delay.

Opened or damaged products caused by the consumer will not be accepted for return. Items must be returned in their original and intact condition.

In the event of withdrawal, Möss will refund all payments received using the original payment method or a bank transfer, depending on the original payment method. Refunds may be delayed until the returned products are received and inspected.

The right of withdrawal also applies to online services. Subscription cancellations related to a product can be made at any time. However, no refund will be issued for any remaining subscription period. The renewal will be notified to the consumer one month before the renewal date.

Article 11 - Personal Data Processing

Möss processes consumer information in accordance with its Privacy Policy.

Article 12 - Dispute Resolution

Möss cannot be held liable for damages resulting from improper use of its products.

In case of a dispute, the consumer should first contact Möss customer service at hello@moss-paris.com to attempt an informal resolution.

Article 13 - Governing Law

This contract and the GTC are governed by French law.
